Lasting power of attorney
Why plan for an LPA?
A Lasting Power of Attorney (LPA) allows you to appoint someone you trust to make important decisions on your behalf if you are no longer able to speak for yourself. This guide will help you understand the process, the different types of LPAs, and how to get started.

What is a lasting power of attorney?
An LPA is a legal document allowing someone to manage your health, welfare, property, and finances if you cannot. There are two types:
- Health and welfare: Covers decisions about medical care, daily routines, and living arrangements.
- Property and finances: Manages bills, bank accounts, and property.
How to set up an LPA
While setting up an LPA might seem daunting, you can write your own LPA through the government website and the process is straightforward if broken into simple steps:
- Choose your attorney: Select someone you trust, such as a family member or solicitor.
- Decide the type of LPA you need: Health and Welfare, Property and Finances, or both.
- Complete the forms: Download from the government website or call 0300 456 0300 for assistance.
- Notify people: Inform those listed in the LPA using the ‘LP3 Form to Notify People.’ They have 3 weeks to raise any concerns.
- Sign with a certificate provider: A professional (doctor or solicitor) or someone who’s known you for 2+ years must confirm you understand the LPA.
- Register with the Office of the Public Guardian: The LPA must be registered to be valid. This process can take up to 10 weeks.
How much does it cost?
- England & Wales: £82 per LPA; £164 for both.
- Scotland: £87 per LPA; £174 for both.
Fee reductions or exemptions may apply for low-income individuals or those on benefits. Additional costs may apply if you choose to seek legal advice or hire a third party to assist with writing your LPA, with fees starting from as little as £120.
